2008 Mileage Rates Published: January 15, 2008. The 2008 optional standard mileage rates were issued by the IRS. These mileage rates are used calculate the deductible costs of operating an automobile for business, charitable, medical or moving purposes. They are also used on Section 8 properties when determining medical expense deductions (See Exhibit 5-3 of HUD Handbook 4350.3 Revision 1, Change 2).

Student Rule Amended: January 9, 2008. On December 20th, H.R. 3648 also known as the Mortgage Forgiveness Debt Relief Act of 2007, was signed into law by President Bush. Besides eliminating the income tax due when mortgage debt is forgiven on a homeowner's principal mortgage, the law also amended a portion of the Housing Credit full-time student rule.

Disaster Areas Declared In California: November 7, 2008. President Bush declared areas in Los Angeles, Orange, Riverside, San Bernardino, San Diego, Santa Barbara, and Ventura counties in California major disaster areas. Subsequently, the California Tax Credit Allocation Committee (TCAC) published a memo on October 25th to remind Tax Credit property owners of the disaster relief procedures established by Revenue Procedure 2007-54.

Fair Market Rents Released: November 7, 2007. HUD published final Section 8 fair market rents (FMRs) for fiscal 2008 in the October 1, 2007 Federal Register.

2008 Social Security & Medicare Benefits Announced: November 6, 2007. The Social Security Administration has announced benefits will increase 2.3% in 2008. The standard Medicare Part B monthly premium will be $96.40 in 2008, an increase of $2.90 from the 2007 $93.50 premium.

Public Hearing On Utility Allowances Held: November 2, 2007. On October 9, the IRS held the public hearing on the proposed utility allowance regulations for the Tax Credit Program which were originally published on June 19.

Revenue Procedure 2007-54: August 13, 2007. The IRS has released Revenue Procedure 2007-54 giving temporary relief from the Section 42 requirements to Housing Credit properties located in areas declared by the President as major disasters on or after July 2, 2007.

Change 2 of HUD Handbook Released: August 1, 2007. The long awaited Change 2 of the HUD Handbook 4350.3 Revision 1 was released on July 16th with a June 29, 2007 effective date. A full Handbook can be obtained by going to HUDClips (www.hudclips.org) and then by clicking on the “what’s new!” link and then by clicking on the Occupancy Requirements of Subsidized Multifamily document located under the 7/18/07 date. This link also contains the HUD Transmittal that summarizes the changes.

Proposed Regulations Published: June 28, 2007. The IRS has published 2 proposed regulations concerning our industry... specifically amended utility allowance rules and qualified contract rules.

HOME Program Income & Rent Limits Published: April 12, 2007. The new rent and income limits for the HOME Program have been released and will become effective Saturday, April 28, 2007. 2nd Annual NCP Conference a Smashing Success!

In January 2000, Elizabeth Moreland Consulting, Inc. introduced a new Housing Credit Designation to the industry called the National Compliance Professional (NCP). Created to allow industry professionals an opportunity to prove their dedication and knowledge in the compliance aspects of the Housing Credit Program, the designation includes a professional certification and a Membership Group.

The Tax Credit Program is tough on its professionals!

Partly because it is still such a new housing program and partly because there are so many gray areas that result in numerous interpretations. But truthfully, the main reason it is so tough is the Program rules are just downright complex!! The pressure on Housing Credit professionals, especially property managers, on-site personnel and compliance specialists, is enormous. Everyone is scrutinizing your work! The chances for noncompliance lurk at every corner!! And the ramifications for noncompliance are expensive ... really, really expensive. 

I don't mean to frighten you ... especially if this is your first exposure to the Tax Credit Program. The Program is great ... REALLY! But it can have a dark side too! Especially for those who enter it for the first time blind or without resources. If you are going to survive in this dog-eat-dog world of Tax Credit compliance, you need to have the best possible resources for information and a continuing funnel of information and ideas coming to you. You will also need to have a group of peers and industry experts you can rely on to be a voice of reason when difficult situations arise, and that truly understand the constraints and difficulties of managing a Tax Credit property!

That is the very reason the

One of the biggest complaints I hear from Tax Credit managers and compliance specialists is that they just don't have the information. If someone would just tell them that new rules are out or that there is an easier way of doing things ... THEY WOULD DO IT!! But that is one of the biggest problems with the Tax Credit Program. There is no regular funnel of information from the IRS and the State Agencies to the people in the trenches!
