HUD/Department of Justice Issue Modification Statement

Department of Justice and HUD have released a "Joint Statement on Reasonable Modifications Under the Fair Housing Act" which is a companion to the "Joint Statement on Reasonable Accommodations Under the Fair Housing Act" which was issued in May 2004.

This joint statement explains the position of these agencies concerning the owner & manager's responsibilities to disabled individuals who make reasonable modification requests. Like the statement regarding accommodations, this modification statement is laid out in a Q/A format and once again shares the basic concept from the statement on accommodations that the request for modification must be linked or connected to the individual's disability.

It will be important for you to become familiar with this document and due to the controversial nature of some of the points given to us in the statement, important that you discuss it thoroughly with your fair housing counsel.
